We have given you this picture at full size in an attempt to demonstrate the drama of a very sophisticated, 10 wheel, computer controlled crane ..... standing on it's tail ! That "duck blind" looking structure to the left of the crane WAS the key element of a new injection molding factory. The crane was pulling its load from a cargo hold of the ocean vessel when distater struck and the entire load crashed to the pier. Alleged loss: US$875,000.The freight forwarder (NVOCC) had moved this unit from overseas on terms whereby the custodial ocean carrier required forwarder loading & unloading of the machine. Our client was alleged to have arranged the crane.
The Law Offices of Countryman & McDaniel came to the defense of the NVOCC in a complicated case involving many companies and claims in several countries. At the end of the day, it was demonstrated that our client had a properly constructed bill of lading which limited damages to US$500 per package under the Carriage of Goods By Sea Act. The entire factory unit was one package. [ NOTE: Damages were properly paid by the crane company. The freight forwarder was spared thousands of dollars in legal costs.]
LESSON LEARNED: The importance of a properly constructed house bill of lading to the freight forwarder [NVOCC] cannot be overly stressed. For specifics & proper use, consult your company attorney or liability advisor.
